Introduction
The Celebrity Series of Boston, Inc. (“Celebrity Series,” “we,” “our” or “us”) respect your privacy and are committed to protecting it through our compliance with this policy.
This policy describes:
· The types of information we may collect or that you may provide when you download, install, create an account on, access, or use ArtsCard Boston (the “Application”).
· Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This policy applies only to information we collect in this Application and in email, text, and other electronic communications sent through this Application.
This policy DOES NOT apply to information that:
· We collect offline or on any other Celebrity Series apps or websites, including websites you may access through this Application.
· You provide to or is collected by any third party, including other apps, websites, or content that may link to or be accessible from or through this Application (see Third-Party Information Collection).
Our websites and apps, and these other third parties have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, access, create an account on, or use this Application. By downloading, accessing, creating an account, or using this Application, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Application after we revise this policy means you accept those changes, so please check the policy periodically for updates.
Minors
The Application is not intended for individuals under 18 years of age. If you are under 18, do not download, access, use or provide any information on this Application, create an account on the Application, make any purchases through the Application, use any social features of the Application, or provide any information about yourself to us through the Application, including your name, address, telephone number, email address, or any screen name or username you may use. If we discover that an individual under the age of 18 has created an account through the Application, that account will be terminated immediately and all information associated with the account will be deleted. If you believe an individual under the age of 18 has created an account on the Application, please contact us at help@artscardboston.com.
Information We Collect and How We Collect It
We collect information from and about users of our Application:
· Directly from you when you provide it to us.
· Automatically when you use the Application.
· From third parties, for example, other arts organizations and non-profit organizations.
Information You Provide to Us
When you download, create an account, or use this Application, we may ask you provide information:
· By which you may be personally identified, such as name, postal address, email address, image of your driver’s license or other photo identification for age verification purposes, telephone number, and other contact information (“personal information”).
· That is about you but individually does not identify you, such as demographic information.
This information includes:
· Information that you provide by filling in forms in the Application. This includes information provided at the time of creating an account on the Application, making a donation, purchasing tickets, signing up for a free event or purchasing a membership on or through the Application, subscribing to our newsletter or email mailing list, or requesting brochures or other information, materials or services from us. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the Application.
· Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
· Your responses to surveys that we might ask you to complete for research and informational purposes.
· Details of transactions you carry out through the Application and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Application. Under some circumstances, you may be re-directed to the website or application of a third party that provides our venues with online ticket sales. If you decide to purchase tickets on, or provide any personal information to, any of these third-party websites or applications, you do so entirely at your own risk and subject to the terms and conditions of use and privacy policies for such website or application.
· Your search queries on the Application.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Application, including when you download, access, or use the Application, we may use automatic data collection technologies to collect certain information about your device and your browsing and usage activity and patterns, including:
· Usage Details. When you access and use the Application, we may automatically collect certain details of your access to and use of the Application, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Application.
· Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, and mobile network information.
· Stored Information and Files. The Application may request access to certain components of your mobile device or other information associated with other files stored on your mobile device. This may include, for example, requests to access your device’s camera, calendar, address book information, photos/media/files, and location data. The purposes of requesting access to this information is to simplify your user experience, improve our services, and provide services that require this information. For example: (a) access to your mobile device’s calendar allows the Application to populate your calendar with events for which you have purchased tickets or in which you have expressed interest; and (b) access to your mobile device’s camera allows the Application to upload a profile picture on your behalf.
It is important for you to understand that before granting access to the device components or information noted above, your mobile device will prompt you to give the Application permission to access such components or information, unless you have turned off these prompts/preferences in your device settings. If you do not wish to grant that permission, you may decline and, if you later change your mind, those permissions may be updated in your mobile device’s settings.
· Location Information. The Application does not currently collect real-time information about the location of your mobile device.
If you do not want us to collect Usage Details or Device Information, do not download, install, create an account, access or use the Application. If you do not want us to access your mobile device’s Stored Information and Files, you may decline the device’s prompts for request for access to same, or decline such access in your device preferences. Please note, however, that declining the Application’s use of certain components or information will make some of the Application’s features and services unavailable to you.
The technologies we use for automatic information collection may include:
· Cookies (or mobile cookies). A cookie is a small file placed on your mobile device. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your mobile device. However, if you select this setting, you may be unable to access certain parts of our Application.
· Web Beacons. Pages of the Application and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Celebrity Series, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).
We do not collect personal information automatically, but we may tie non-personal information collected automatically to personal information about you that we collect from other sources or that you provide to us.
Third-Party Information Collection
When you use the Application or its content, certain third parties may use automatic information collection technologies to collect information about you or your mobile device. These third parties may include:
· Advertisers.
· Analytics companies.
· Your mobile device manufacturer.
· Your mobile service provider.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, to:
· Provide you with the Application and its contents, and any other information, products, or services that you request from us.
· Fulfill any other purpose for which you provide it.
· Give you notices about your account and events for which you purchase tickets through your account.
· Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
· Notify you when Application updates are available, and of changes to any products or services we offer or provide though it.
The usage information we collect helps us to improve our Application and to deliver a better and more personalized experience by enabling us to:
· Estimate our audience size and usage patterns.
· Store information about your preferences, allowing us to customize our Application according to your individual interests.
· Speed up your searches.
· Recognize you when you use the Application.
We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. If you do not want us to use your information in this way, please adjust your user preferences in the Application’s settings. Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.
In addition, we may disclose personal information that we collect or you provide:
· To our subsidiaries and affiliates.
· To contractors, service providers, and other third parties we use to support our business. For example, we share personal information with ticket-issuing organizations (presenters, promoters, or producers) at the point of sale. We may also share personal information with payment processors, age verification vendors, marketing partners, and data analytics providers.
· To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Celebrity Series’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Celebrity Series about our Application users is among the assets transferred.
· To third parties, including other arts organizations and non-profit organizations to market their products or services to you if you have not opted out of these disclosures. For more information, see Choices About How We Use and Disclose Your Information.
· To fulfill the purpose for which you provide it.
· For any other purpose disclosed by us when you provide the information.
· With your consent.
We may also disclose your personal information:
· To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
· To enforce our rights arising from any contracts entered into between you and us, including the ArtsCard Boston Terms of Service , and for billing and collection.
· If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Celebrity Series, our customers, donors, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.
· Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of the Application may then be inaccessible or not function properly.
· Promotion by Celebrity Series. If you do not want us to use your contact information to promote our own or third parties’ events, products or services, you can opt-out by logging into the Application and adjusting your user preferences in your account profile, or by sending us an email stating your request to help@artscardboston.com.
· Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can send us an email stating your request to help@artscardboston.com.
· Stored Information and Files; Camera. You can choose whether or not to allow the Application to access your mobile device’s camera, calendar, address book information, and photos/media/files through the device’s privacy settings. If you decline the Application’s access to these components and files, certain services included in the Application may not be available to you.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.
Accessing and Correcting Your Personal Information
You can review your personal information by logging into the Application and visiting your account profile page.
You can edit or correct your email address by logging into the Application and visiting your account profile page. In order to edit or correct any of your other personal information contained in the Application, you must send us an email at help@artscardboston.com stating your request. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
Links from the Application
If the Application contains links to other applications, websites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those applications, websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party applications, websites or resources linked to this Application, you do so entirely at your own risk and subject to the terms and conditions of use and privacy policies for such applications, websites or resources.
Geographic Restrictions
The owner of the Application is based in the Commonwealth of Massachusetts in the United States. We provide this Application for use only by persons located in the United States. We make no claims that the Application or any of its content is accessible or appropriate outside of the United States. Access to the Application may not be legal by certain persons or in certain countries. If you access the Application from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.
Data Security
We have implemented measures intended to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to the Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we use reasonable efforts to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Application.
Changes to Our Privacy Policy
You acknowledge and agree that Celebrity Series has the right, in its sole discretion, to modify this privacy policy from time to time. You will be notified of modifications through the Application or via direct email communication from Celebrity Series. You are responsible for reviewing and becoming familiar with any such modifications. Your continued use of the Application after such notification will be deemed acceptance of the modified terms.
